TUMCAR Rental Terms and Conditions

Important Information: By completing a reservation through TUMCAR, the customer confirms that they have read, understood and accepted the following rental terms and conditions. Reservation-specific information such as price, vehicle group, mileage, insurance coverage, payment method, pick-up/return details and other special conditions will also be stated in the reservation confirmation.

Article 1 – TUMCAR Service Model

TUMCAR is a vehicle reservation and brokerage platform working with authorised and licensed car rental companies throughout Turkey. TUMCAR receives the customer's reservation request, coordinates the selection of a suitable vehicle group and rental partner, follows the reservation process and sends the reservation confirmation to the customer.

Vehicle delivery, vehicle return, preparation of the rental agreement and operational procedures during the rental period are carried out by the TUMCAR rental partner specified in the reservation.

TUMCAR's role primarily consists of organising and facilitating the reservation, transmitting the necessary information between the customer and the rental partner and providing customer service support in connection with the reservation.

Article 2 – Reservation and Confirmation

A reservation request submitted through the website, telephone, WhatsApp, email or another communication channel does not by itself constitute a confirmed reservation. The reservation becomes confirmed after vehicle availability has been checked and the reservation has been confirmed by TUMCAR.

The customer is responsible for providing accurate and complete information, including their full name, telephone number, email address, pick-up and return dates and times, flight information and any other information required to process the reservation.

The vehicle group, total price, rental period, pick-up/return location, mileage allowance and special conditions stated in the reservation confirmation shall apply to the relevant reservation.

Article 3 – Vehicle Pick-Up

The vehicle will be delivered to the customer on the date, at the time and at the pick-up location specified in the reservation.

At the time of vehicle delivery, the customer must present a valid driving licence together with a passport or other valid official identification document.

The customer is advised to inspect the general condition of the vehicle upon delivery and to ensure that any existing scratches, dents or other damage are recorded on the vehicle delivery form.

In the event of a flight delay, change of flight number or change in the scheduled pick-up time, the customer should inform TUMCAR or the responsible rental partner as soon as possible.

Article 4 – Vehicle Return

The vehicle must be returned on the agreed date, at the agreed time and at the agreed return location.

If the customer is unable to return the vehicle at the agreed time, the responsible rental partner must be informed in advance. An unauthorised extension of the rental period may result in additional rental charges.

Upon return, the rental company may check the condition of the vehicle, mileage, fuel level and any new damage that may have occurred during the rental period.

Article 5 – Driver Requirements and Additional Drivers

The rented vehicle may only be driven by persons who are registered as drivers in the rental agreement and who meet the applicable driver requirements.

Minimum driver age and the required length of time for holding a valid driving licence may vary depending on the vehicle group and the rental partner. Higher age and driving licence requirements may apply to premium vehicles, SUVs, minibuses and other higher vehicle categories.

If another person is to drive the vehicle, that person must be registered in the rental agreement as an additional driver. Use of the vehicle by an unauthorised or unregistered driver may affect or invalidate insurance and protection coverage.

Article 6 – Vehicle Group, Make and Model

Vehicle photographs displayed on the TUMCAR website are examples representing the relevant vehicle group.

Reservations are generally made for a vehicle group rather than for a specific make and model. Unless a specific make and model is expressly guaranteed in the reservation confirmation, no guarantee is given regarding a particular make, model, colour, model year or equipment specification.

If the originally planned vehicle is unavailable, an equivalent vehicle from the same or a comparable group may be provided. Where operationally necessary, a vehicle from a higher category may also be supplied.

Article 7 – Insurance and Protection Coverage

The insurance and protection coverage applicable to the vehicle is determined by the services stated in the reservation confirmation and by the conditions of the relevant rental partner.

Depending on the reservation, one or more of the following coverages may be included:
• CDW – Collision Damage Waiver
• TP/TW – Theft Protection
• TPL – Third Party Liability
• Mini Damage Protection
• Extended Liability Protection
• PAI – Personal Accident Insurance

The existence of insurance or a protection package does not mean that every type of damage is automatically covered without limitation. The coverage, excess/deductible, exclusions and conditions stated in the reservation confirmation and rental agreement shall apply.

Article 8 – Accident, Damage, Breakdown and Theft

In the event of an accident, damage, breakdown or theft, the customer must immediately inform TUMCAR and the rental partner that supplied the vehicle.

Where required, the police or other competent authorities must be contacted and an official accident or incident report must be obtained. The necessary details of all parties and vehicles involved should also be recorded.

The customer must not arrange repairs, replacement of parts or other work on the vehicle without prior approval from the rental partner.

Failure to obtain required reports or failure to report an incident promptly may affect insurance or protection coverage.

Article 9 – Prohibited and Improper Use

The rented vehicle must be used safely, legally and in accordance with its intended purpose.

Driving under the influence of alcohol or drugs, use by an unauthorised driver, racing, illegal use, serious traffic violations, inappropriate off-road use or taking the vehicle outside Turkey without the required permission is prohibited.

Insurance and protection coverage may be partially or completely invalidated where damage results from prohibited, unlawful or improper use of the vehicle.

Article 10 – Traffic Fines, HGS, Tolls and Parking Charges

All traffic fines, speeding or parking violations, HGS charges, motorway tolls, bridge and tunnel charges, ferry charges and parking fees incurred during the rental period are the responsibility of the customer.

Fines or charges received by the rental partner after the end of the rental period may subsequently be notified to and charged to the customer.

Article 11 – Fuel Policy

The vehicle is delivered with the fuel level recorded at the time of pick-up and should normally be returned with the same fuel level.

If the vehicle is returned with less fuel, the cost of the missing fuel and, where applicable, a refuelling or service charge may be applied.

Damage and expenses resulting from the use of an incorrect fuel type may be charged to the customer and may not be covered by insurance.

Article 12 – Mileage Policy

Where the reservation confirmation states “Unlimited Mileage”, no agreed mileage limit applies to that reservation during the rental period.

For reservations subject to a mileage limit, the daily or total mileage allowance will be stated in the reservation confirmation.

If the stated mileage limit is exceeded, an additional charge per excess kilometre may be applied according to the conditions of the rental partner.

Article 13 – Payment

Unless otherwise agreed at the time of reservation, the rental amount is paid to the TUMCAR rental partner at the time of vehicle pick-up.

Depending on the conditions of the relevant rental partner, payment may be made in cash, by credit/debit card or by another accepted payment method.

Where the reservation states “No Advance Payment”, the rental amount is not collected from the customer when the reservation is initially made.

Article 14 – Deposit, Pre-Authorisation and Credit Card

Deposit, security pre-authorisation and credit card requirements may vary depending on the selected vehicle group and the conditions of the rental partner.

Where the reservation confirmation expressly states “No Deposit” or “No Credit Card Required”, the special conditions confirmed for that reservation shall apply.

Where these conditions are not expressly stated in the reservation confirmation, the rental partner's standard deposit, security pre-authorisation and/or credit card requirements may apply.

Article 15 – Cancellation and Reservation Changes

Cancellation or amendment requests should be communicated to TUMCAR as early as possible.

Changes to the pick-up date, return date, time, location, vehicle group or rental period are subject to a new availability check. A change to the reservation may also result in a change to the originally confirmed price.

Where Free Cancellation or Free Reservation Changes are expressly included in the reservation, the specific time limits and conditions stated for that reservation shall apply.

Article 16 – Protection of Personal Data

Customer information required to process the reservation, prepare the vehicle and complete vehicle delivery may be shared between TUMCAR and the rental partner responsible for fulfilling the reservation.

Such information may be used for reservation processing, customer communication, vehicle pick-up and return procedures and compliance with applicable legal obligations.

Article 17 – Responsibilities of TUMCAR and the Rental Partner

TUMCAR coordinates the reservation process, facilitates the selection of an appropriate rental partner, transmits reservation information between the parties and provides customer service in connection with the reservation.

The rental partner supplying the vehicle is responsible for preparing and delivering the vehicle, preparing the rental agreement, the technical and operational condition of the vehicle, accepting the vehicle upon return and carrying out operational procedures during the rental period.

Where a problem arises, TUMCAR may provide communication and coordination support between the customer and the relevant rental partner.

Article 18 – Disputes and Applicable Law

In the event of a dispute relating to the vehicle rental, the parties should first seek to resolve the matter through communication and mutual agreement.

For matters relating to the rental transaction and the use of the vehicle in Turkey, the applicable laws and regulations of the Republic of Turkey shall apply.

The statutory rights and jurisdiction of competent courts, consumer arbitration committees and other competent authorities remain unaffected.

Article 19 – Acceptance of the Rental Terms and Conditions

By completing a reservation through TUMCAR, the customer confirms that they have read, understood and accepted these Rental Terms and Conditions.

The conditions specifically stated in the customer's reservation confirmation, including the price, vehicle group, insurance coverage, mileage allowance, payment method, deposit/pre-authorisation requirements, pick-up/return location and other special conditions form an integral part of the reservation.

Where an expressly confirmed reservation-specific condition differs from these general Rental Terms and Conditions, the special condition expressly confirmed for that particular reservation shall apply.
